Danger Signs We Ignored for 105 Years are Ominously Back on the Horizon



There are thousands of issues that take the attention of the citizenry everyday. However, national security cannot be pushed to the backburner. Tamil Elamists are on the march again. Tamil intellectuals, priests, academics, lawyers, teachers, doctors and various other ‘front-end’ service providers who constantly interact with thousands of people have demanded from the TNA that it sticks to its guns of Tamil racism. They have warned TNA against “giving into” government pressure and dropping Tamil nationalist demands including a Tamil Nation for 85 million Tamils around the world.


Readers are requested to read the above and take a note of the signatories, their professions and take in the fact that they are opinion creators in the society.

Since ancient times Tamil invaders tried to take over the island nation. They were violently defeated. Sri Lankan policy makers since 1948 let the past bury its dead and carried on regardless of the imminent danger that was unfolding around them.

We don’t seem to be doing anything about it! Doing the same thing (or abstaining from doing what needs to be done) and expecting a different result is insanity according to the great mathematician Albert Einstein. History is already repeating. It will be a matter of years when the next major terrorist attack occurs.

Tamil violence and ultimately militancy grew stage by stage since the late 19th century.





Why didn’t we see this coming? – Earliest warnings of Tamil violence 
“In 1871, Caste clashes erupted between Vellalar, dhoby caste and barber caste in Maviththapuram. The root cause of the riot was alleged that dhoby caste people refused to wash the clothes of barber caste people. Vellalar caste people were blamed for the violence. This is the first known caste/race riot in the island.

September, 1923 saw another caste riot in Jaffna. In Sutumalai, Vellalars attacked Paramba caste people who had hired drummers for a funeral alleging that Paramba caste people had no right to emplot drummers for their funerals as they were ‘low caste’. In 1931 a similar violent riot took place in Canganai, Jaffna where Pallar caste individuals were attacked by Vellalar people for hiring drummers for a funeral. According to Tamil tradition, only ‘high caste’ people could hire drummers and ‘professional mourners’ (a unique practice in the north) for funerals.

In June 1929 caste riots broke out again in the north in response to the ‘equal seating directive’ of the government which was applicable to grant-aided schools. Under this directive ‘low caste’ students were allowed to sit on the bench. Until then they sat either on the floor or outside the classroom. Resultant riots bunt a large number of houses mainly of low caste Tamils. Their children en masse were stopped from attending schools. Repeated petitions were made to the government by ‘high caste’ Vellalars begging to cancel the directive!”

If the Vellahla Tamils could unleash violence for nothing on their own kind, what would stop them from using violence against the Sinhalese? Please note that the first race riot was not the 1915 riot but the 1871 (105 years before the start of the Vadukoddai War in 1976) caste riot within the Tamil community. Since then, until independence, periodic Tamil caste riots took place. Tamils were also responsible for the 1939 Tamil-Sinhala riot that started in Nawalapitiya and the 1958 riot started with SJV Chelvanayagam’s tar brush campaign against the Sinhalese and the Sinhala language. Even the 1983 riot was initiated by Tamil Tigers. The 1985 Tamil-Muslim riot and the 2002 Valachchenei Tamil-Muslim riot were also initiated by Tamil nationalists.

Despite these clear indications, why didn’t we see a full scale war coming our way following independence?

Why didn’t we see this coming? – Latter warnings of Tamil violence 
“The failure of the 1961 “satyagraha” set several (Federal Party) leading lights thinking. Mahatma Gandhi, they argued, succeeded in India with his concept of non-violence and non-cooperation because he was leading a majority against a minority, however powerful; whereas in Sri Lanka, the Tamils were a minority seeking rights from a majority. And the majority was not willing to give concessions.

Some of 20 men associated with the Federal Party thought Gandhism had no place in such a scenario. They decided after the prolonged deliberations to form an underground group to fight for a separate state. Most of them were civil servants and had been influenced by Leon Uris Exodus. At a meeting in Colombo, they christened their group Pulip Padai (Army of Tigers).

On August 12, 1961, the Pulip Padai members converged at the historic Koneswaran Temple in the eastern port town of Trincomalee and, standing in its holy precincts facing the sea took a solemn oath to fight for a Tamil homeland.

Pulip Padai immediately got into the act, putting out leaflets and pamphlets printed clandestinely, advocating militancy. A student wing called the Manavar Manram (students council) was set up in 1963. Two Federal Party leaders the Pulip Padai strongly backed were Amirthalingam and V.Navaratnam ( Chavakachcheri MP).

Two of them were A.Rajaratnam and K.Sivagnanasundaram. Rajaratnam died in 1975 in Madras of asthma.( Rajaratnam was awarded a gold medal posthumously by Pirabaharan at a Jaffna public meeting after Rajiv Gandhi’s assassination. Indian investigators believe that Dhanu, the woman who acted as the human bomb to kill Gandhi was Rajaratnam’s daughter). Sivagnanasundaram became the staunch supporter of the LTTE. He was killed in Jaffna in 1988 by the EPRLF.

In 1969, Thangathurai and Kuttimuni and a few friends gathered in Jaffna to form an informal group that the former wanted to name the Tamil Liberation Organisation (TLO).

A college Prof’s house at Point Pedro, in Jaffna, was a regular meeting point for the group. It included among others Periya (big) Sothi, Chinna (small) Sothi, Chetti, Kannadi (a radio mechanic), Sri Sabaratnam (TELO leader) and V.Pirabaharan (LTTE supremo). One man who drifted by but broke away to chart an independent course was Ponnudorai Sivakumaran, who was to become one of the first martyrs to the Tamil cause.

In April, 1971, Thangathurai, known as mama ( uncle) and some 15 others were making explosives at the Thondamanar high school when a bomb went off, seriously injuring Chinna Sothi. The next year, a similar blast occurred, causing burn injuries to Thangathurai, Chinna Sothi, Pirabaharan and V.Nadesuthasan.”

The funny thing was they met in Colombo and formed the Army of Tigers in 1961! What were we doing?
Also of note is how government servants (teachers and lecturers) spearheaded the terrorist campaign while on the payroll of the government. Rings a bell? Well this is being repeated today!

What ought to have been done to the initial group of Tamil nationalists? They should have been secretly eliminated from the society without a trace. That could have saved the Tamil society from total destruction. The link between the creation of the political need for a Tamil nation by Chelvanayagam, etc. to the experiments with bombs is clearly explained in the above book.  

Why didn’t we see this coming? – Humble beginnings of uncontrollable Tamil violence 
“The first successful robbery blamed on Tamil militants took place in 1974 when 91,000 rupees was taken away from the Multipurpose Cooperative Society of Tellipallai. Tamil sources said Chetti and one of his cousins were among the responsible for the robbery, while one published account attributed the raid to Pirabaharan. Around the same time Chetti slipped to Tamil Nadu and teamed up with a crowd Valvettithurai that was camping in Salem.”

On March 5, 1976 Pirabaharan led a raid on the state run People’s Bank at Puttur and escaped with a half a million rupees in cash and jewellery worth of 200,000 rupees after holding the employees at gun point. It was the first successful bank robbery in Jaffna.”

 These were matters to be handled by the armed forces not by the police. Despite the JVP using these very same tactics in 1971 to finance its violent campaign, the then government ignored them. It was a grave mistake for which the nation would pay a very heavy price. Lack of counter insurgency expertise was the main reason for the failure. Security was given a break until a dire security situation arose. At the very least now, this “wait and see” approach must change.  

 What most of us didn’t know about the 1970s Tamil Diaspora
Did the Tamil Diaspora turn anti-Sri Lankan after 1983 riots? No. Tamil Diaspora especially those who were in the United Kingdom were looking for violence and separatism way back in the early 1970s.
“EROS was formed in 1975 by Eliyathamby Ratnasabapathy and Shankar Rajee, both of whom were living in Great Britain at the time. Initially a think-tank concerned with Tamil issues, its leadership established ties with the Palestinian Liberation Organization and formed militant training camps in Sri Lanka. These camps eventually militarized and trained most of the rebels who formed other Tamil movements in the 1980s. Although the most radically nationalist of all the Tamil groups, EROS was the least militarily active of all such groups. However, the group was responsible for a string of bombings in Sri Lanka in the mid-1980s as well as for the kidnapping of British journalist Penelope Willis.

EROS gradually lost its influence as Tamil independence movements emerged as offshoots of EROS. These groups, the largest of which is the Liberation Tigers of Tamil Eelam (LTTE), took the majority of EROS members with them.”

Tamil intellectuals in the Tamil Diaspora with their resources, intellect, networking and organisational skills initiated the Tamil armed violence that was absorbed by the LTTE and ran with it. This not only gave the LTTE vital initial funds, but also an international network.
Isn’t this what is happening today?

The only solution
Equipped with the knowledge of history, ancient, past and modern, we must approach this problem proactively. Support for Tamil Elam was not the same in all Tamil enclaves in the island nation. It was mostly concentrated on the north which was over 96% Tamil at that time. Today the north is 100% Tamil as others are not allowed to live there by Tamil politicians and their voters.

State sponsored and military backed new settlement schemes must be put in place to dissolve Tamil-only ideologies. Tamil separatists must be identified early through a wide spread secret service and eliminated without a trace. Time to time the northern Tamil-only societies should be given baits to identify Tamil separatists hiding in the society. Tamil Diaspora activists’ local agents should be closely monitored and any suspicion of Tamil nationalism should be handled using appropriate violence. There are no sizable pro-Sri Lankan Tamil Diaspora groups at the moment.

Giving into Tamil demands is the worst crime the government can do. Appeasement doesn’t solve any problem. Instead it encourages further demands. Northern development should be separated from developing Tamils. Northern development should benefit 74% Sinhalese, 8% Muslims, 12% Sri Lankan Tamils, 5% upcountry Tamils and 1% others.

The only political solution is ethnic integration, especially in the north by creating multi ethnic colonies. Any other political solution will fail and end up in war again.
Every year the government spends 750 billion rupees of taxpayer money on the Jaffna University. Unfortunately the Jaffna University is at the heart of Tamil separatism. From student unions to prominent lecturers, graduates and connected persons, there is a huge movement towards Tamil racism. Are we to allow this in the open?


At the moment there are 5,000 undergraduates studying at the Jaffna University, almost 99% of undergraduates and lecturers are Tamils. Just like a Tamil Nadu university. It was a very unwise move by the government to establish the Jaffna University in 1974 that is now a hotbed and safe house of Tamil racism. Tamil intellectuals instead of being grateful to the then government for a Tamil-only university, strongly drifted to the ultra-racist Vadukoddai Resolution at the 1977 election. It is time to learn lessons or dig our own grave with our own money.

The government should strongly clamp down on lecturers and students who engage in promoting Tamil nationalism. Disciplinary action must be taken and either the university should be weakened gradually or the ethnic composition should be changed. Interestingly although the government follows a strict approach towards all other university student trouble, it has been very reluctant to discipline Jaffna University’s violent and illegal student unions! Naturally this will encourage further violence.

National security related decisions must be taken by those who are educated and experienced in defence, not by those ignorant of defence. The former group would use military theory to resolve matters successfully whereas the latter group would resort to unscientific means to resolve the issue. LTTE violence never responded to spiritual, moral or religious approaches.


Peace everyone enjoys today came after millions of kilograms of bombs were dropped in Tiger controlled areas, tens of thousands of artillery and mortars fired at them and the entire shipping fleet of Tamil Tigers was sunk in the mid-sea. These extreme measures can be avoided if and only if troublemakers are identified early and eliminated. There aren’t the resources to mollycoddle them. Nor the people have the patience to put up with them and their racist demands.

The young Saudi who goes under the alias, Ox Omar, who hacked Israeli account and published details of18,000 credit cards on Tuesday, released a new list of 11,000 Israeli credit cards on Saturday according to Al Arabiya.

In an interview with the Israeli newspaper, Yediot Ahronot, the hacker Omar said the newly released information include names, telephone numbers and addresses of credit card holders and he promised to expose another batch of 80,000 credit cards.

Omar said that he is determined to financially and socially hurt Israel.

“This is only the beginning and you will see that I will leak information of other credit cards that contain detailed information of Israelis, in addition to military and technical documents,” the hacker who is only 19 years-old told the newspaper.

“Israel attacks and kills innocent Palestinians and commits genocide against them, in addition to the international law violation,” he added.

Asked to comment on whether he thought he was hurting Israeli Arabs, he dismissed the notion that Arabs live in Israel adding that, “Arabs live in occupied Palestine and Israel is a just part of the Palestinian occupied state … Arabs in Israel should help in getting rid of the occupation.”

The young hacker told the newspaper that he has purchased items totaling $200,000 from the credit cards he has hacked into over the last two years.

Dov Kotler, CEO of Isracard, Israel’s largest card company, said in a statement on Thursday that 5,200 of the credit card numbers listed by the hacker had been issued by his company. They had all now been blocked, he added.

The Bank of Israel was looking into the incident, a spokesman said.

Moshe, old boy, superb and very timely article. These matters have been bugging me for a long time too. With that list of bastards who have put their signatures on the separatist declaration we have a nice starting point. We already have the laws in the books, namely the PTA, to handle these instigators of mass murder. These buggers fall under the offenses specified in PTA, namely:

Any person -
(h) who by words either spoken or intended to be read or by signs or by visible representations or otherwise causes or intends to cause commission of acts of violence or religious, racial or communal disharmony or feelings of ill-will or hostility between different communities or racial or religious groups;


According to PTA

(2) Any person guilty of an offence specified in -
(ii) paragraphs (c), (d), (e), (f), (g), (h), (i) or (j) of subsection (1) shall on conviction be liable to imprisonment of either description for a period not less than five years but not exceeding twenty years.


Anybody on that list who cannot be taken care of by 'the unit', may be due to their social standing, should be thrown in the slammer for 20 years. Most of these old buggers would never come out alive.
But make sure they are not held together to plot inside prison walls.

The two-day (January 4-5) seminar on “Missionary Activities and Human Rights: Recommended Ground-rules for Missionary Activities” which the ‘Oslo Coalition on Freedom of Religion or Belief’ organized in Kandy came a cropper on the second day when Buddhist protestors both monks and lay persons prevented participants from entering the premises of the Sri Lanka International Buddhist Academy at Pallekele, Kundasale, the venue of the event. The SIBA is a branch of the Dalada Maligawa, (Temple of the Sacred Tooth) Kandy.

The protests were in the form of a peaceful Satyagraha although the police were present to prevent any breach of the peace. Among those who had to turn back was the Bishop of Kandy who came in his car to attend the seminar. Altogether 25 scholars and religious leaders from both Buddhist and Christian communities had been invited.

The protestors demanded to know what right had the Norwegians who never condemned the murderous LTTE attack in January 1998 on the Dalada Maligawa - which is of utmost symbolic value to Buddhists and Sri Lanka in general – to sponsor a religion-related seminar at SIBA. The Chandrika Bandaranaike Government invited Norway to be ‘peace facilitator’ in Sri Lanka in 1997 – the year before the attack.

A SRI Lankan asylum-seeker says his countrymen must learn that the long journey across the Indian Ocean is perilous.

Since November last year, 17 Sri Lankans, including teenage brothers aged 13 and 14, have died in two separate incidents trying to reach Christmas Island.

The survivors of the most recent tragedy, mainly Tamils, are in detention on Christmas Island, where they say they did not know help was coming when five of their fellow passengers jumped overboard in a doomed attempt to swim to land.

Pararasasingam Paheertharan, who survived when 12 of his fellow passengers drowned off the Cocos (Keeling) Islands last November, told The Australian it was important to publicise the dangers of the long journey."

"Defence Secretary Gotabhaya Rajapaksa said that the possible re-emergence of the LTTE is one of the biggest challenges faced by the country in the post conflict period and that the military has identified the threat and steps have been taken to make Sri Lanka’s intelligence services stronger and establish camps in strategic locations.

“LTTE front organisations can encourage and facilitate ex LTTE cadres and those who escaped from the military during the war and pave way for a re-emergence. Those who did not surrender are probably following the ideology of the LTTE. Even though 11,000 of them were rehabilitated there must be cadres who are not 100 per cent rehabilitated,” he said.

“We cannot forget everything just because we defeated them militarily. Still the threat is there. There are lots of enemies in the international front taking active steps to derail the path the government is taking to achieve economic development,” he said speaking at a lecture on the topic, ‘Future Challenges of National Security in Sri Lanka’ organised by the Sri Lanka Foundation Institute and ANCL.

“That is why we still maintain a strong military and that is why a considerable portion of the budget is given to the military. Still it is only two and a half years after defeating the LTTE militarily,” he added.

He charged that certain groups for political means charge that the country is heading towards militarisation. Presently day to day law and order is maintained by the police. “To establish a camp anywhere in Sri Lanka is a decision and concern of the country as it is a sovereign state,” he noted.

“Currently the front organisations of the LTTE and their supporters are taking internal problems of Sri Lanka to the international level,” he said.

The Defence Secretary also noted that the country will have to face the geopolitical situation due to the strategic location the country.

“Organisations such as Global Tamil Forum and British Tamil Forum pressurise the international community and western governments to put more pressure on Sri Lanka by all means. They want the international community to look negatively at Sri Lanka and that is how the pressure is taken on us,” he said.

The Defence Secretary charged that these LTTE front organisations are closely associated with the international media and that is how they spread the message just like they did by airing the video footages through Channel-4. These organisations also run schools by the name of Thamil Cholai which gives education to about 15,000 students."

EPC needs land powers to preserve traditional Tamil homeland: R. Thurairatnam

Land powers should be provided to Eastern Provincial Council in order to safeguard the traditional homeland of Tamil speaking people from being plundered by the Colombo government under the pretext of setting up army cantonments and implementing tourist and various corporate projects, councilor of the EPC from Batticaloa district R.Thurairatnam, has said. Two third of the so-called state lands in the eastern province come under the centralized authority of the Colombo. The existing powers on lands are not enough no stop plundering lands in the Eastern province by the central authority, Mr. Thurairatnam, said bringing a motion introduced by him in the council meeting on the land issue.

Thurairatnam added that the central government has been setting up military camps in the lands that belong to Tamil speaking people, handing over lands to tourist projects, to the Forest Department and Mahaweli Development Authority without referring the matter to the provincial authorities and without obtaining their consent. The legal and illegal acquisition of lands belonging to minority communities are being carried out in the province during the conflict and after.

He stressed that this type of activity carried out by the Colombo government would not help to bring reconciliation between communities at any time.

Illegal acquisition of lands of Tamil speaking people is being carried out by Colombo government with a covert plan to make the Tamil speaking people into a minority in the province forever.

Colombo government is continuously authorizing the acquisition of lands in the East, leaving the District Secretariats, Divisional Secretariats and provincial land authority in dark.

He said provincial council should be conferred with full powers of lands to put a full stop to the illegal acquisition of lands in the East and that the EPC administration should demand the central government that land powers should be handed over to it.

In a clear articulation of US State Department's continuing support of Sri Lanka's President Rajapakse, the US Justice Department, based on a directive from legal adviser Harold Koh, has suggested to the District Court of District of Columbia that Rajapakse has immunity from the suit filed by three Tamil plaintiffs for alleged complicity in war-crimes.

Now Bruce Pain, the ambulance chaser, tricking toilet cleaners again asking for 45 days of retainer. These buggers are beyond belief.

Bruce Fein, Plaintiffs’ attorney, told TamilNet, State Department's action is a clear violation of the separation of powers architected by the founding fathers in the US Constitution. He added that he will file a motion asking for 45 days to respond to the the suggestion of immunity.

SUGGESTION OF IMMUNITY SUBMITTED BY THE UNITED STATES OF AMERICA

Pursuant to 28 U.S.C. § 517,1 the United States respectfully informs this Honorable Court of the interest of the United States in the pending lawsuit against His Excellency President Mahinda Rajapaksa (sued as “Percy Mahendra Rajapaksa”), the President and sitting head of state of the Democratic Socialist Republic of Sri Lanka, and hereby suggests to the Court the immunity of President Rajapaksa from this suit.2 In support of its interest and suggestion, the United States sets forth as follows:

1. The United States has an interest in this action because the sole Defendant, President Rajapaksa, is the sitting head of state of a foreign state, thus raising the question of President Rajapaksa’s immunity from the Court’s jurisdiction while in office. The Constitution assigns to the U.S. President alone the responsibility to represent the Nation in its foreign relations. As an incident of that power, the Executive Branch has sole authority to determine the immunity from suit of sitting heads of state. The interest of the United States in this matter arises from a determination by the Executive Branch of the Government of the United States, in consideration of the relevant principles of customary international law, and in the implementation of its foreign policy and in the conduct of its international relations, to recognize President Rajapaksa’s immunity from this suit while in office.3 As discussed below, this determination is controlling and is not subject to judicial review. No court has ever subjected a sitting head of state to suit once the Executive Branch has suggested the head of state’s immunity.

2. The Legal Adviser of the U.S. Department of State has informed the Department of Justice that Sri Lanka has formally requested the Government of the United States to suggest the immunity of President Rajapaksa from this lawsuit. The Legal Adviser has further informed the Department of Justice that the “Department of State recognizes and allows the immunity of President Rajapaksa as a sitting head of state from the jurisdiction of the United States District Court in this suit.” Letter from Harold Hongju Koh to Tony West (copy attached as Exhibit 1).

3. The immunity of foreign states and foreign officials from suit in our courts has different sources. For many years, such immunity was determined exclusively by the Executive Branch, and courts deferred completely to the Executive’s foreign sovereign immunity determinations. See, e.g., Republic of Mexico v. Hoffmann, 324 U.S. 30, 35 (1945) (“It is therefore not for the courts to deny an immunity which our government has seen fit to allow, or to allow an immunity on new grounds which the government has not seen fit to recognize.”). In 1976, Congress codified the standards governing suit against foreign states in the Foreign Sovereign Immunities Act, transferring to the courts the responsibility for determining whether a foreign state is subject to suit. 28 U.S.C. §§ 1602 et seq.; see id. § 1602 (“Claims of foreign states to immunity should henceforth be decided by courts of the United States and of the States in conformity with the principles set forth in this chapter.”).

4. As the Supreme Court recently explained, however, Congress has not similarly codified standards governing the immunity of foreign officials from suit in our courts. Samantar v. Yousuf, 130 S. Ct. 2278, 2292 (2010) (“Although Congress clearly intended to supersede the common-law regime for claims against foreign states, we find nothing in the statute’s origin or aims to indicate that Congress similarly wanted to codify the law of foreign official immunity.”). Instead, when it codified the principles governing the immunity of foreign states, Congress left in place the practice of judicial deference to Executive Branch immunity determinations with respect to foreign officials. See id. at 2291 (“We have been given no reason to believe that Congress saw as a problem, or wanted to eliminate, the State Department’s role in determinations regarding individual official immunity.”). Thus, the Executive Branch retains its historic authority to determine a foreign official’s immunity from suit, including the immunity of foreign heads of state. See id. at 2284–85 & n.6 (noting the Executive Branch’s role in determining head of state immunity).

5. The doctrine of head of state immunity is well established in customary international law. See Satow’s Guide to Diplomatic Practice 9 (Lord Gore-Booth ed., 5th ed. 1979). In the United States, head of state immunity decisions are made by the Department of State, incident to the Executive Branch’s authority in the field of foreign affairs. The Supreme Court has held that the courts of the United States are bound by suggestions of immunity submitted by the Executive Branch. See Hoffman, 324 U.S. at 35–36; Ex parte Peru, 318 U.S. 578, 588–89 (1943). In Ex parte Peru, in the context of foreign state immunity, the Supreme Court, without further review of the Executive Branch’s immunity determination, declared that the Executive Branch’s suggestion of immunity “must be accepted by the courts as a conclusive determination by the political arm of the Government.” 318 U.S. at 589. After a suggestion of immunity is filed, it is the “court’s duty” to surrender jurisdiction. Id. at 588. The courts’ deference to Executive Branch suggestions of foreign state immunity is compelled by the separation of powers. See, e.g., Spacil v. Crowe, 489 F.2d 614, 619 (5th Cir. 1974).

6. For the same reason, courts have also routinely deferred to the Executive Branch’s immunity determinations concerning sitting heads of state. See Ye v. Jiang Zemin, 383 F.3d 620, 626 (7th Cir. 2004) (“The obligation of the Judicial Branch is clear — a determination by the Executive Branch that a foreign head of state is immune from suit is conclusive and a court must accept such a determination without reference to the underlying claims of a plaintiff.”); Saltany v. Reagan, 702 F. Supp. 319, 320 (D.D.C. 1988) (holding that the suggestion of Prime Minister Thatcher’s immunity was conclusive in dismissing a suit that alleged British complicity in U.S. air strikes against Libya), aff’d in part and rev’d in part on other grounds, 886 F.2d 438 (D.C. Cir. 1989). When the Executive Branch suggests the immunity of a sitting head of state, judicial deference to that suggestion is predicated on compelling considerations arising out of the Executive Branch’s authority to conduct foreign affairs under the Constitution. See Ye, 383 F.3d at 626 (citing Spacil, 489 F.2d at 618). Judicial deference to the Executive Branch in these matters, the court of appeals noted, is “motivated by the caution we believe appropriate of the Judicial Branch when the conduct of foreign affairs is involved.” Id. See also Spacil, 489 F.2d at 619 (“Separation-of-powers principles impel a reluctance in the judiciary to
interfere with or embarrass the executive in its constitutional role as the nation’s primary organ of international policy.” (citing United States v. Lee, 106 U.S. 196, 209 (1882))); Ex parte Peru, 318 U.S. at 588.4 As noted above, in no case has a court subjected a sitting head of state to suit after the Executive Branch has suggested the head of state’s immunity.

7. Under the customary international law principles accepted by the Executive Branch, head of state immunity attaches to a head of state’s status as the current holder of the office. After a head of state leaves office, however, that individual generally retains residual immunity only for acts taken in an official capacity while in that position. See 1 Oppenheim’s International Law 1043–44 (Robert Jennings & Arthur Watts eds., 9th ed. 1996). In this case, because the Executive Branch has determined that President Rajapaksa, as the sitting head of a foreign state, enjoys head of state immunity from the jurisdiction of U.S. courts in light of his current status, President Rajapaksa is entitled to immunity from the jurisdiction of this Court over this suit.

CONCLUSION

For the foregoing reasons, the United States respectfully suggests the immunity of
President Rajapaksa in this action.

“India must now concentrate on the Finlandization of Sri Lanka,” Avery writes, while referring to Finland’s subjugation by the Soviet Union during the Cold War. “In the short term this will mean preventing any further non-Indian involvement in Sri Lanka’s affairs.”

Avery described how China invested millions to turn the sleepy fishing hamlet of Hambantota in Sri Lanka into a booming new port, just off India’s southeast coast, furthering an ambitious trading strategy in South Asia that is reshaping the region and forcing India to rethink relations with its neighbours.

China has been developing port facilities in Pakistan, Bangladesh and Myanmar, and it is planning to build railroad lines in Nepal. These projects, analysts like Avery argue, are irksome to India; there are worries that China is expanding its sphere of regional influence by surrounding India with a “string of pearls” that could eventually undermine India’s pre-eminence and potentially rise to an economic and security threat.

Avery worries that India’s economic growth since 1991 has not been matched by an appropriate increase in its global political clout. It is now, however, beyond the shadow of a doubt that the Obama administration, like the previous Bush administration, is investing in a long-term strategic partnership with India, and has identified China as a threat while declaring Asia as a priority to the US.

Sri Lanka is the only country where low level Government officials (the GAs and lower) especially in the North and East (thus entirely Tamils) can issue birth certificates and passports if they feel like it, and Tamils being Tamils will always help “a brother out” especially when trying to punish and subjugate a non-Tamil.

In the end Sri Lanka will become a Tamilian dominated state, Sinhalese will then not only be openly persecuted they will be told to Tamilise or be wiped out as Tamilians are an intolerant and vicious bunch driven by their racism and barbaric violence.

His main point on the original article (to which Cabraal replied ) was 'Like protecting currency notes in millions or billions of rupees, the Governor of the Central Bank also has to be closely protected. Hence, the insertion was by air and the exit by road. No previous Governor of the Central Bank enjoyed such privileges, which nowadays even an ordinary Cabinet Minister finds difficult to obtain.

Wonder how much the day trip by chopper cost the Treasury and the public, three per cent depreciation of the rupee notwithstanding.'.

Jamis Banda should have ideally published entire response from Cabraal and appologised to Cabraal instead just 'stand corrected' and publish 'selected' portions of the reply, for wrongly accusing him of using state funds for personal travel. But then again Journalists in Sri Lanka are no different to Politicians, arent they?

Pol Sambol, old boy, this looks like a Bell 212 Twin Huey from No. 7 Squadron. You can distinguish between Bell 212s and Bell 412s operated by No. 4 Squadron (VIP transport) by number of blades in the main rotor. Bell 412 has a composite four-blade main rotor while 212 only has a two blade rotor. I think No. 7 operates ten Bell 212s for training, troop transport and MEDEVAC.

New Delhi: India's 1.3 million-strong armed forces, hobbled by outdated equipment and slow decision-making, are undergoing an overhaul as defence priorities shift to China from traditional rival Pakistan.
And like a refit of the imposing but dilapidated Defence Ministry on Delhi's grand South Block, it's a plodding process.
Defence chiefs are hurrying to modernise aging weaponry as China reinforces a 3,500-km (2,200-mile) shared but disputed border through the Himalayas.

It took 11 years to select France's Rafale as the favoured candidate for a $15 billion splurge on 126 new combat jets to replace a Soviet-era fleet of MiGs dubbed "flying coffins" for their high crash rate.
At the same time, feeling encircled as China projects its fast-growing naval power from Hormuz to Malacca, India is rushing to firm up friendships the length and breadth of the Indian Ocean.
India is the world's largest arms importer with plans to spend $100 billion on weapons over the next decade.
"The Indian military is strengthening its forces in preparation to fight a limited conflict along the disputed border, and is working to balance Chinese power projection in the Indian Ocean," U.S. Director of National Intelligence James R. Clapper told the U.S. Senate this week.
That "balance" includes a strategic alliance with Washington that in turn has stoked Chinese fears of containment. It is due to test-fire its nuclear capable Agni V rocket in the next few weeks, with a strike range reaching deep into China.
In 2009, the air force reopened a high-altitude, landing strip in Ladakh last used during a 1962 border war with China. Along with other Himalayan bases, it is now upgrading the strip for fighter operations.
About 500 Indian MiG-21s have plunged to the ground since the 1960s, yet the jet is still in use, raising the question of whether painfully slow defence procurement procedures can come up with new hardware faster than old equipment is sent to the scrap heap.
According to Indian media, Russia delivered the nuclear submarine INS Chakra on a 10-year lease at the end of last month, eight years after India first asked for it.
A shortfall of about 200 planes means the air force is operating at its lowest level in decades - just 33 squadrons against a goal of 45. By the time all the Rafales are delivered, more MiGs will have been decommissioned.

Both forces are now smaller than 20 years ago, but China's has a fast-growing core of 350 advanced combat jets, including its own Sukhois. It also has a stealth fighter programme.
India's military modernisation plans are focused on the navy and air force, more than the army, which has traditionally squared off with Pakistan. But with Pakistan's air force also modernising fast, India risks losing its edge on two fronts.
In the 1980s, a scandal engulfed the government of then-prime minister Rajiv Gandhi over millions of dollars in kickbacks on artillery contracts for Sweden's Bofors.
Weapons purchases have since been a tortuous process, with rules rewritten several times to avoid graft.
"There has been a tremendous shortage of artillery systems acquisition after the Bofors scandal," said Rahul Roy Chaudhury, a South Asia expert at London's IISS security think tank.
Defence Minister AK Antony is known to be very cautious, with no desire to be caught up in corruption scandals that have in recent years returned to haunt the government.
On Tuesday, he made clear no deal would quickly be signed for the Rafale or any other fighters.
"Meeting of minds"
The relationship between India and China is complex, involving as much cooperation as competition. But while the generals and admirals rarely say as much publicly, India fears a repeat of a brief, humiliating 1962 border war and wants to be prepared for surprises.
Seafaring officers from 14 countries from New Zealand to the Seychelles have gathered on remote Indian islands in the Bay of Bengal this week for exercises and a "meeting of minds" about maritime security.
It is one of the largest such gatherings of maritime allies that India has organised, but China and Pakistan were conspicuously not on the guest list.
Predictably, since China is also a major trading partner, India's assistant chief of naval staff, Admiral Monty Khanna, was at pains to play down China's absence.
"There are many nations that have not been invited," Khanna said in New Delhi, adding China would not be discussed at the meeting. "India and China might share a land border but we are quite distant by sea," he said.
Distant they may be, but increasingly the world's fastest-growing major economies find themselves jostling as they compete for resources, sea lanes and allies. A lack of friendly engagement increases the risk of misunderstandings.
This week's exercises are being held on the Andaman Islands, where India is spending $2 billion to set up a military command and from where the contested and congested South China Sea is only a short hop away.
Last year, India's INS Airavat, an amphibious assault vessel that sailed from the Andamans was challenged in the South China Sea by a radio caller identifying himself as an official of the Chinese navy. Both sides later played down the incident.
"The Indian navy is coy about formally engaging with the Chinese navy because it feels that, if it does, it legitimises the Chinese naval presence in the Indian Ocean," said Roy Chaudhury.
"There needs to be much more communication, especially navy to navy, because they are bumping into each other more and more."
